PROFESSIONAL TRAINING
Me Bouchard holds civil and common law diplomas from the University of Ottawa and has been a member of the Quebec bar since 1981. He also practices as a consultant in industrial relations (CRIA) and has been a member of the Quebec association of human resource professionals since 1987.
PROFILE
Me Serge Bouchard is a partner in the Labour and Education sector. From the beginning of his career, he focused his professional activities in the area of labour relations, for private businesses as well as municipalities and other public entities. His practice has led him to plead before most of the administrative tribunals in matters of labour relations in Quebec and before the Canada Industrial Relations Board at the federal level. In 1992, he was a lecturer at Université Laval and replaced a law professor in order to teach labour law when the latter took a sabbatical leave. The title of the course was “Union law”.
From 1990 to 2003, Me Bouchard taught labour law and negotiation techniques and strategies to students completing their professional training with the Quebec Bar. Since 1981, he exclusively represents employers in all of their labour relations files. He has represented employers before the Supreme Court of Canada for questions relating to section 45 of the Labour Code and the definition of the concept of employer.
In addition, he negotiates collective agreements or important contracts and advised a clientele of employers, mainly with respect to the elements of employment law, discrimination, pay equity and occupational health and safety. He also acts as a resource person, lecturer, panelist or commentator for many employer organizations within the context of workshops in matters of labour relations. He published an article called «L’inconstitutionnalité du protonotaire spécial» in Cahiers de droit [1981], a specialized legal journal.
Me Bouchard adheres to principles of negotiation based on equity, transparency and respect of the rule of law. He prioritizes stable labour relations notably based on a social contract.
Furthermore, he is familiar with litigation resolution methods to the exclusion of the courts and represents parties in mediation, conciliation or private arbitration.
Finally, Me Bouchard represents many carriers in the area of the personal transportation industry before administrative and judicial courts for different questions relating to the transportation industry.
PROFESSIONAL AND COMMUNITY ACTIVITIES
Me Bouchard is a member of the board of directors of the Association for the support and use of the French language (ASULF), a not-for-profit organization which strives for the protection of quality French without errors in the written communications of the medias. From 1995 to 2001, he was a member of the board of directors and the executive committee as well as president of Centraide Quebec. He was a member of the panel of experts of Centraide Quebec and a member of the board of directors of the Fondation communautaire du Grand Québec from 2000 to 2003. He also volunteers for organizations working in genealogy and history and have collaborated with them in the drafting of the history of families, a memoir related to questions of privacy rights and genealogy.
